Welcome to Ashby & Hale Harrogate. When you visit or use our webshop (ashbyandhaleharrogate.com) and our services, you agree to the following terms of service. Please read them carefully. If you do not agree, we kindly ask you not to use the webshop or our services.

These terms apply to purchases you make as a consumer. They do not limit the rights you have under mandatory UK consumer law, including the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

SECTION 1 – TERMS FOR THE WEBSHOP

By accepting these terms, you confirm that you are at least 18 years old, or that you have parental/guardian consent if you are under 18.

You must not use our products for illegal purposes or violate applicable laws. You must not transmit viruses or other harmful code. Breaching these terms may result in your access to our services being terminated.

SECTION 2 – GENERAL TERMS

We reserve the right to refuse service to anyone for any reason. You may not reproduce, copy, sell, resell or otherwise exploit any part of our services without our express written permission.

SECTION 3 – ACCURACY OF INFORMATION

We do our best to provide accurate information but cannot guarantee that all information is always complete, up-to-date or error-free. Use of the webshop content is at your own risk. However, this does not affect your rights if a product does not conform to the purchase agreement.

SECTION 4 – CHANGES TO SERVICES AND PRICES

Prices and product availability may change without notice. We reserve the right to modify or discontinue any product or service at any time. Changes do not affect orders we have already confirmed – the price you paid applies. All prices are in pounds sterling (£) including VAT.

SECTION 5 – PRODUCTS

Some products may only be available online. We strive to display colours and images as accurately as possible, but we cannot guarantee that your screen will display colours exactly.

We reserve the right to limit sales to certain persons, geographic areas or jurisdictions. Product descriptions, prices and availability may change without notice.

SECTION 6 – PAYMENT AND ACCOUNT INFORMATION

You agree to provide complete and accurate information when making purchases and creating an account. We may, at our discretion, limit or cancel orders. If we cancel an order you have already paid for, we will notify you and refund the full amount.

SECTION 7 – OPTIONAL TOOLS

Any third-party tools are provided "as is" and "as available" without endorsement. Use of them is at your own risk.

SECTION 8 – LINKS TO THIRD PARTIES

The webshop may contain links to other websites. We are not responsible for their content, privacy policies or practices.

SECTION 9 – COMMENTS AND SUBMITTED CONTENT

Comments and other content you submit to us may be used without compensation. You agree not to submit content that is illegal, offensive or infringes others’ rights.

SECTION 10 – PERSONAL DATA

Your personal data is processed in accordance with our privacy policy and the General Data Protection Regulation (GDPR).

SECTION 11 – ERRORS, INACCURACIES AND OMISSIONS

We may correct errors, inaccuracies or omissions and update information at any time without notice.

SECTION 12 – PROHIBITED USE

You must not use the webshop for illegal, harmful or misleading purposes or to infringe others’ rights. We may terminate your access for violations.

SECTION 13 – DISCLAIMER AND LIMITATION OF LIABILITY

The webshop and our services are provided "as is" and "as available". To the extent permitted by law, we are not liable for direct or indirect losses resulting from use of the webshop.

This limitation does not affect your mandatory consumer rights. You always have your statutory rights under the Consumer Rights Act 2015 if a product is faulty (see section 20), and the limitation does not apply in cases of intentional wrongdoing, gross negligence or where product liability law applies.

SECTION 14 – INDEMNITY

To the extent permitted by law, you agree to indemnify Ashby & Hale Harrogate and its affiliates and employees against claims or losses arising from your breach of these terms.

SECTION 15 – SEVERABILITY

If any provision is unenforceable, it will be removed without affecting the rest of the terms.

SECTION 16 – TERMINATION

Rights and obligations arising before termination remain in effect. We may terminate your access at our discretion for violations.

SECTION 17 – ENTIRE AGREEMENT

These terms constitute the entire agreement between you and Ashby & Hale Harrogate regarding the webshop and our services – subject to the rights you have under mandatory law.

SECTION 18 – GOVERNING LAW, JURISDICTION AND COMPLAINTS

These terms are governed by UK law, and any disputes will be resolved by the UK courts. This does not affect the protection you have under mandatory laws of the country where you reside.

If you have a complaint about a purchase, please contact us first at support@ashbyandhaleharrogate.com – we will work with you to find a solution. If we cannot agree, you may contact the Citizens Advice consumer service or an approved alternative dispute resolution (ADR) provider.

SECTION 19 – CHANGES TO THE TERMS

We may update these terms at any time. By continuing to use the webshop, you accept the changes. Each purchase is governed by the terms in effect when you placed your order.

SECTION 20 – RETURNS, CANCELLATION RIGHTS AND COMPLAINTS

All details are in our returns policy. In brief:

  • 30-day cancellation right from the day you receive the item – longer than the 14 days required by law. You do not need to provide a reason.
  • You cancel by giving us an unequivocal statement, e.g. an email to support@ashbyandhaleharrogate.com or the form below. We ask you to contact us before returning the item so we can email you the return address – but a return will never be refused just because it was not approved in advance.
  • Return the item within 14 days of notifying us of your cancellation. You pay the return postage.
  • You may try the item as you would in a shop. If the item is used, washed, damaged or missing tags and original packaging, we may deduct an amount corresponding to the diminished value.
  • Your order number serves as proof of purchase.
  • We will refund the purchase price including the original standard delivery costs to your original payment method within 14 days of receiving your cancellation notice. However, we may wait to refund until we have received the item or you have provided proof of return postage. There is no restocking fee.
  • Statutory rights: If an item is faulty, you have your statutory rights under the Consumer Rights Act 2015, valid for 2 years from the day you received the item. Please contact us within a reasonable time after discovering the fault.
